The Danish Financial Business Act and executive orders, guidelines, etc. that are issued pursuant to this Act, is the centrepiece of regulation of financial undertakings, including insurance undertakings. However, due to Denmark's membership of the European Union, the national legislation should be viewed in the context of European regulation.
Before the Solvency II regime was introduced, European regulation in the field of insurance consisted solely of directives. With the adoption of the Solvency II Directive (Directive 2009/138/EC), which consolidated 13 existing insurance directives, the set-up was changed, with the Directive introducing 79 powers to adopt supplementary regulation. The supplementary regulation currently consists of delegated regulations, implementing regulations and guidelines.
